Tracking Website Visitors

This Website also collects general, non-identifiable data including pages visited, operating systems, Internet domain, time and date of visit, and web browser type (Windows, Safari, Mozilla, Opera, etc.) and version for statistical purposes. A unique number called an IP address identifies each computer on the Internet. Each time users connect to the Internet, their computer is assigned an IP address. When users connect to Chordline Health’s Website, the IP address is stored in an anonymous form without reference to your person for statistical purposes. This information is collected automatically without user interaction. By collecting this information, Chordline Health may analyze on which days and at which time the Chordline Health Website is particularly frequented. The non-personal identifiable information we gather may be used to improve our Website.

In some cases, you may elect to “opt-in” to receive educational materials or participate in a webinar.  In those instances, you may be asked to fill out a form with basic contact information.  We may collect “Personal Information” about you, such as your name, address, telephone number, email address or company information when you:

Chordline Health reserves the right to amend these Terms and Conditions in the event that this becomes necessary due to gaps in these Terms and Conditions identified after their release, or in the event that it becomes necessary with respect to additional or amended services provided by Chordline Health.

Standard Technical Support

Technical support is available 7:30 AM – 4:30 PM PT, Monday through Friday, except on Chordline Health holidays.  Should there be a need for additional emergency Support Services after-hours, on holidays, or weekends, a technical support representative will be available on-call.  Emergency support services shall be limited to system wide outages only.  If emergency support services are requested for non-system-wide outages, Chordline Health will invoice Licensee for such support at the current fee-for-service rate.

Technical support requests should be sent to TechSupport@chordline.com with supporting information that identifies the Error.  Chordline Health will respond within one (1) business of all support requests.

If the Parties determine that the root cause of the issue is not an Error, but another issue impacting the Software such as a custom import or export process, hardware, other third party software, network operating systems, or other technical environment issues, then Chordline Health shall not be obligated to provide Support Services.

Any technical support request that are determined to be enhancement or configuration change requests will require a fee-for-service agreement and invoiced at the current fee-for-service rate.

 

 

Termination and Return of Data Policy

Return of Data Policy is defined in ACUITY Advanced Care EULA, Effect of Termination.

The following policy outlines the ACUITYNXT Termination and Return of Data policy as referenced in the ACUITYNXT Terms of Service Agreement, Section 30 (a) – Effects of Termination. This document will be updated on a regular basis to ensure regulatory compliance, updated product features and operational efficiency.

The Customer data will be provided in Microsoft Excel format, with the data elements outlined in Appendix A – Termination Data Elements.

Questions/Answers about Termination

  1. If I terminate my contract with ACUITYNXT, will I have an opportunity to download my data?

    1. Chordline Health, Account Management team will submit a ticket on behalf of your termination to extract data from your account. Once data has been extracted, you will no longer have access to your ACUITYNXT account.

  2. What happens to my data after the actual termination date?

    1. Chordline Health, will continue to retain the Customer’s data for an additional 30 days after terminate date.

  3. During the 3- day Data Retention Period, will ACUITYNXT continue to maintain privacy, security and integrity of my data as defined by HIPAA?

    1. Yes, Chordline Health will continue to extend the protections of the BAA agreement during the data retention period.

  4. How will I receive my data from Chordline Health Healthcare?

    1. Chordline Health, will return your data to you by leveraging our standard file distribution method of Box.com.

 

  

Medical Code Set End-User Agreement 

Medical Code Sets are licensed pursuant to the Agreement and this Addendum.  To the extent that this Addendum is inconsistent with the Agreement – with respect to Medical Code Sets – this Addendum supersedes the Agreement.  This Addendum does not apply to other aspects of the Service.

Words that are defined in the Agreement are used herein as therein defined.

License.  Chordline Health hereby grants You a nontransferable, nonexclusive license to use the Medical Code Sets (“MCS”) solely in connection with Your internal use of the Service in the United States of America, its territories and possessions.  This license is granted pursuant to a right to sublicense from the American Medical Association (“AMA”). The MCS, including any of the AMA’s Current Procedural Terminology (“CPT”) and all data files therefore are copyrighted by the AMA and “CPT” is a registered trademark of the AMA. The AMA is a third-party beneficiary of the Agreement and this Addendum.

Restrictions.  You may not publish MCS, distribute MCS over the Internet or other public computer based information system, create derivative works (including translations), transfer, sell, lease, license or otherwise make the MCS available to any unauthorized party, whether in whole or in part, and whether in connection with the Service or otherwise.

Term.  This license granted only for the term of the Service and the provision of updated MCS is dependent upon a continuing contractual relationship between Chordline Health and the AMA.

Authorized Use.  You must ensure that anyone to whom you grant access to the MCS will comply with the Agreement and this Addendum, and that each of Your Authorized Users (as defined in this Addendum) authorizes Chordline Health to provide such Authorized User’s name to the AMA.

You will accurately count and report the number of Authorized Users to Chordline Health.

You must ensure that anyone to whom You grant access to the MCS complies with the Agreement as modified by these terms and conditions of this Addendum.

Additional Definitions. 

“Editorial Content” means content from the print publication Current Procedural Terminology, Fourth Edition or any additional additions or updates to such publication, and the data files of Current Procedural Terminology, a coding work of nomenclature and codes for reporting healthcare services as published in a variety of formats by the American Medical Association.

The term “Authorized User” as defined in the Agreement and this Addendum shall include:

An individual who:

  • Accesses, uses, or manipulates CPT Editorial Content and/or AMA’s version of ICD-10-CM/PCS and/or AMA’s version of HCPCS, as applicable, contained in the Service; or

  • Accesses, uses, or manipulates the Service to produce or enable an output (data reports, or the like) that could not have been created without the CPT Editorial Content and/or AMA’s version of ICD-10-CM/PCS and/or AMA’s version of HCPCS, as applicable, embedded in the Service even though CPT Editorial Content and/or AMA’s version of ICD-10-CM/PCS and/or AMA’s version of HCPCS, as applicable, may not be visible or directly accessible; or

  • Makes use of an output of the Service that relies or could not have been created without the CPT Editorial Content and/or AMA’s version of ICD-10-CM/PCS and/or AMA’s version of HCPCS, as applicable, embedded in Service even though CPT Editorial Content and/or AMA’s version of ICD-10-CM/PCS and/or AMA’s version of HCPCS, as applicable, may not be visible or directly accessible.

“Authorized Users” of CPT Assistant and/or CPT Changes are defined to include the following:

an individual who accesses or has access to CPT Assistant and/or CPT Changes Editorial Content, as applicable, contained in the Service.

U.S. Government Rights.

This product includes CPT which is commercial technical data, which was developed exclusively at private expense by the American Medical Association (AMA), 330 North Wabash Avenue, Chicago, Illinois 60611.  The AMA does not agree to license CPT to the Federal Government based on the license in FAR 52.227-14 (Data Rights – General) and DFARS 252.227-7015 (Technical Data – Commercial Items) or any other license provision.  The AMA reserves all rights to approve any license with any Federal agency.

You may only make copies of the MCS for backup or archival purposes and all such copies must include all notices of proprietary rights, including trademark and copyright notices.  All notices of proprietary rights, including trademark and copyright notices, must appear on all permitted back up or archival copies made.

Additional Limitations on Warranties and Liabilities for Editorial Content.  Editorial Content contained within the Service is provided “as is”, and Chordline Health and the AMA disclaim any liability for any consequential damages due to use, misuse or interpretation of information contained or not contained in Editorial Content.  Neither Chordline Health nor the AMA shall be liable to any Authorized User with respect to the MCS,  including, without limitation, liability for consequential or special damages or lost profits,  for sequence, accuracy or completeness of data.
